Intro

Workplace injuries happen across Virginia – from shipyards on the Peninsula to healthcare facilities in Richmond to manufacturing plants in Southwest Virginia.

Virginia workers compensation is governed statewide by the Virginia Workers Compensation Commission. The rules are the same everywhere. The insurance company tactics are the same everywhere.

What changes is who understands your local employers, your local medical landscape, and the practical realities of getting your claim handled correctly.

Why Location Matters in Virginia Workers’ Compensation

Virginia workers compensation law is uniform statewide. So why does location still matter?

Hearings are regional, not centralized

Hearings are typically scheduled at regional hearing locations based on where the injury occurred. Even when the same Deputy Commissioner hears cases from multiple cities – Newport News and Hampton cases, for example, are often heard in Hampton by the same Deputy Commissioner – local employer practices, medical providers, and job markets (because of vocational rehabilitation) still shape how claims unfold.

For more on how the Commission operates, see our guide to the Virginia Workers Compensation Commission’s powers and procedures.

Local employers create predictable patterns

A Newport News shipyard injury involves different employers, insurers, and defenses than a warehouse accident at an Amazon location in Chesterfield County or an injured nurse’s claim at at a Roanoke healthcare facility. Understanding the dominant employers in your area helps anticipate return-to-work pressure, surveillance issues, and causation disputes before they arise.

We’ve represented workers injured at Newport News Shipbuilding, Sentara Healthcare facilities, Riverside Health System, Amazon fulfillment centers, and manufacturing operations throughout Southwest Virginia. That experience means we know what to expect before we pick up the phone.

Panel physicians differ by region

Insurance companies select the doctors on your employer’s panel. Some physicians practice independently. Others regularly work with insurance carriers and may approach treatment, work restrictions, and permanent impairment ratings differently. Knowing how panel physicians typically operate in your area matters for protecting your medical care and wage benefits.

If you’re having trouble getting appropriate treatment, see our guide on how to change doctors in your workers compensation case.

Medical networks and referrals aren’t uniform

Getting authorization for surgery, specialist referrals, or second opinions often depends on regional medical networks. A lawyer who understands how treatment authorization usually plays out in your area can help prevent delays that jeopardize benefits like temporary total disability or ongoing lifetime medical coverage.

You do not need a lawyer in your city. Virginia workers compensation cases proceed through the Commission regardless of where you live, and we travel as needed for depositions, medical appointments, and hearings.

What you need is a lawyer who understands Virginia workers’ compensation: the Commission’s rules, the insurance companies’ playbook, and the medical and vocational evidence that determines what your claim is worth.

Questions About Location and Workers Compensation

Do I need a lawyer in my city?

No. You can work with any Virginia-licensed attorney. Hearings are scheduled at regional hearing locations, not necessarily in your hometown, and most case work happens by phone, email, and video. What matters is experience with the system—not physical proximity.

What if I was injured in one city but live in another?

Your claim is filed with the Virginia Workers Compensation Commission regardless of where the injury occurred or where you live. Virginia typically has jurisdiction if you were working in Virginia when injured. The Commission will assign your claim to the correct regional office, which in turn will determine the hearing location.

What if my employer is based out of state?

If your injury occurred in Virginia, Virginia workers compensation law usually applies even if your employer is headquartered elsewhere. Multi-state employment situations can be complex – we handle these cases regularly and can explain how jurisdiction applies to your situation

.

For more details, see our guide on multi-state workers compensation jurisdiction.

Do you travel for cases?

Yes. We handle cases throughout Virginia and travel as needed for depositions, medical appointments, Commission hearings, and mediations.

What does a workers compensation lawyer cost?

We work on a contingency basis – you pay nothing unless we recover benefits for you. Virginia law caps attorney fees in workers’ compensation cases at 20% of your recovery, and fees must be approved by the Commission.
